A Tribute to Bernard E. Witkin ? Michael Reiter, Attorney at Law Blog

Most practicing attorneys have an appreciation for practice guides, which are succinct, helpful volumes dedicated to how to do particular things.? Usually, we are taught in law school, we should not cite directly to practice guides, because they are secondary sources.? One exception may be (and still, it should be done sparingly) is a citation to Bernard E. Witkin?s treatises, the Summary of California Law, California Procedure, California Evidence, and California Criminal Law.? My legal research and writing instructor even referred to Mr. Witkin as ?Uncle Bernie.?? Our courts in California have had little trouble citing to Witkin (according to one source over 20,000 times) versus using primary law, but that is an honor usually reserved to the judiciary.

To say that Bernard Witkin is held in high esteem is an understatement.? Here are some epithets given to Bernard Witkin and judicial sentiments reflecting the esteem felt towards Mr. Witkin? in California case law:

?the eminent Bernard E. Witkin? Continental Airlines, Inc. v. McDonnell Douglas Corp. (1988) 216 Cal.App.3d 388, 421.

?the venerable Bernard E. Witkin? People v. Hinton (2004) 121 Cal.App.4th 655, 662.

?Bernard E. Witkin, beyond question the foremost commentator on California law? People v. Barraza (1979) 23 Cal.3d 675, 695.

?The legal sage Bernard E. Witkin authoritatively advises? Corbett v. Franchise Tax Bd. (1985) 167 Cal.App.3d 808 (Not officially published).

The California Legislature held Bernard Witkin in similar esteem; California Education Code section 19328(a)? reads:

The Legislature hereby finds and declares that Bernard E. Witkin?s legendary contribution to California law is deserving of a lasting tribute and an expression of gratitude from the state whose legal system, he, more than any other single individual in the 20th century, helped to shape.

The Supreme Court of California convened in San Francisco on December 3, 1996 to remember Bernard Witkin about a year after he died.? The Supreme Court holds such sessions when someone connected to the court dies, but according to his remarks on that day, then-Chief Justice Ronald M. George said it was the first time an individual other than a staff member or justice of the court was so honored.? Justice Ming Chin said that Governor Pete Wilson called him ?the Guru of California Law,? that former Chief Justice Lucas said that the ?Witkin summaries of California Law made us the envy of the nation? and Justice Ching said that ?Bernie Witkin and California law have always been synonymous.?? Justice Norman Epstein of the Second District Court of Appeal called him ?the Justinian of California.?

The reason why Witkin was? and is ?so revered is that he laid down black letter law without the nonsense that you see in more academic writing about the law.? Even more than 16 years after his death, I am indebted to the work he pioneered in the last century.

12 dead in shooting at Colorado movie theater

A lone gunman dressed in riot gear burst into a movie theater in Aurora, Colo., at a midnight showing of the Batman film "The Dark Knight Rises" and methodically began shooting patrons, killing at least 12 people and injuring at least 50.

The suspect, James Holmes, 24, of Aurora, was caught by police in the parking lot of the Century 16 Movie Theaters, nine miles outside Denver, after police began receiving dozens of 911 calls at 12:39 a.m. MT. Police said the man appeared to have acted alone.

Witnesses in the movie theater said Holmes crashed into the auditorium through an emergency exit about 30 minutes into the film, set off a smoke bomb, and began shooting. Holmes stalked the aisles of the theater, shooting people at random, as panicked movie-watchers in the packed auditorium tried to escape, witnesses said.

"You just smelled smoke and you just kept hearing it, you just heard bam bam bam, non-stop. The gunman never had to reload. Shots just kept going, kept going, kept going," one witness told ABC News.

"I'm with coworkers and we're on the floor praying to God we don't get shot, and the gunshots continue on and on, and when the sound finally stopped, we started to get up and people were just bleeding," another theatergoer said.

Police said 10 victims died inside the theater, while dozens of others were taken to local hospitals, including a child as young as 6 years old.

A San Diego woman identifying herself as James Holmes's mother spoke briefly with ABC News this morning.

She had awoken unaware of the news of the shooting and had not been contacted by authorities. She immediately expressed concern that her son may have been involved.

"You have the right person," she said.

"I need to call the police," she added. "I need to fly out to Colorado."

Holmes was wearing a bullet-proof vest and riot helmet and carrying a gas mask, rifle, and handgun, when he was apprehended, according to police. Holmes mentioned having explosives stored, leading police to evacuate his entire North Aurora apartment complex and search the buildings early this morning.

The highly-anticipated third installment of the Batman triology opened to packed auditoriums around the country at midnight showings on Friday morning, and features a villain named Bane who wears a bulletproof vest and gas mask. Trailers for the movie show explosions at public events including a football game. Though many moviegoers dressed in costume to attend the opening night screening, police have made no statements about any connection between the gunman's motives and the movie.

Police in New York have intensified security around showings of the film throughout the five boroughs today, with police commissioner Ray Kelley saying that "as a precaution against copycats and to raise the comfort levels among movie patrons in the wake of the horrendous shooting in Colorado, the New York City Police Department is providing coverage at theaters where the 'The Dark Knight Rises' is playing."

The Paris premiere of the movie has been cancelled in the wake of the shootings. "Warner Bros. is deeply saddened to learn about this shocking incident. We extend our sincere sympathies to the families and loved ones of the victims at this tragic time," the movie's producers, said in a statement.

Witnesses watching movies in theaters next to the one where the shooting took place said bullets tore through the theater walls and they heard screaming.

"The suspect throws tear gas in the air, and as the tear gas appears he started shooting," said Lamar Lane, who was watching the midnight showing of the movie with his brother. "It was very hard to breathe. I told my brother to take cover. It took awhile. I started seeing flashes and screaming, I just saw blood and people yelling and a quick glimpse of the guy who had a gas mask on. I was pushed out. There was chaos, we started running."

One witness said she saw people dropping to the ground after the gunshots began.

"We were maybe 20 or 30 minutes into the movie and all you hear, first you smell smoke, everybody thought it was fireworks or something like that, and then you just see people dropping and the gunshots are constant," witness Christ Jones told ABC's Denver affiliate KMGH. "I heard at least 20 to 30 rounds within that minute or two."

A man who talked to a couple who was inside the theater told ABC News, "They got up and they started to run through the emergency exit, and that when she turned around, she said all she saw was the guy slowly making his way up the stairs and just firing at people, just picking random people," he said. "The gunshots continued to go on and on and then after we didn't hear anything...we finally got up and there was people bleeding, there was people obviously may have been actually dead or anything, and we just ran up out of there, there was chaos everywhere."

Witnesses and victims were taken to Gateway High School for questioning.

Hundreds of police and FBI agents are involved in the investigation. A senior official who is monitoring the situation in Washington said that early guidance based on the early snapshot of this man's background indicated that this act does not appear to be linked to radical terrorism or anything related to Islamic terrorism.

Though police have said that they believe the shooter was acting alone, they checked all cars in the parking lot and cleared the area near the theater.

Dr. Comilla Sasson, at the University of Colorado Hospital where many of the victims were taken, said they are currently operating on nine critical patients and have treated 22 in all. She called the hospital "an absolutely terrifying scene all night."

In a statement, President Obama said, "Michelle and I are shocked and saddened by the horrific and tragic shooting in Colorado. Federal and local law enforcement are still responding, and my administration will do everything that we can to support the people of Aurora in this extraordinarily difficult time. We are committed to bringing whoever was responsible to justice, ensuring the safety of our people, and caring for those who have been wounded."

A man who was in the adjacent theater with his son, said that the commotion began as one of the action scenes was starting up.

"These guys came through, and they say someone's shooting," he said. "I thought, 'Oh, they must have heard the fireworks, you know ... I had no idea. And then the alarms started to go off in the theater.'"

An explosive device was also found inside the movie house. Police are not sure whether the device, which investigators are calling a bomb, was already in place or whether it was thrown into the crowd.

Ambulances rushed to the scene as audience members fled the theater.

Investigators are now interviewing friends and associates of the suspect to get a sense of the man's background.

Europol To Lead International Cyber Security Protection Alliance ...

Alliance to pool intelligence from business, government, law enforcement, security agencies, and professionals

(London and The Hague) July 18, 2012: One of the largest international consultations into cybercrime has been launched to help governments, law enforcement and businesses get a head start on cybercriminals.

Called Project 2020, the study by the International Cyber Security Protection Alliance and led by its strategic law enforcement partner Europol will analyze current trends in cybercrime and how they may evolve over the next eight years and beyond.

The Threat

The past two years have seen the industrialization of cybercrime, where criminals can draw on an entire supporting infrastructure of criminal service providers ? from web hosting to generating credit card verification data. With more information about all of us on the web than ever before, we also have seen a sharp increase of targeted cyber attacks, so-called spearphishing.

?During the past 24 months, critical infrastructure in countries around the world has been under daily cyber attack from both organized criminal networks and state-sponsored entities,? says John Lyons, the Chief Executive of the International Cyber Security Protection Alliance.

Europol expects these threat scenarios to evolve rapidly: Cloud computing services mean that we don?t always know to whom we are entrusting our data. The ?internet of things? could see the hacking of medical devices and key infrastructure components.

?With two-thirds of the world yet to join the internet, we can expect to see new criminals, new victims and new kinds of threats,? says Dr Victoria Baines, Strategic Advisor on Cybercrime at Europol.

The Project

What makes Project 2020 unique is that it will combine the expertise of leading law enforcement agencies with that of the ICSPA?s member companies, organizations and professional communities.

The European Commission recently designated Europol as its information hub on Cybercrime and asked the agency to establish the European Cybercrime Centre (EC3). Also contributing to the study will be the City of London Police and the European Network and Information Security Agency (ENISA).

Among the business members joining Project 2020 are payment services firm Visa Europe, the UK?s largest home shopping retailer Shop Direct Group, customer insight and fraud prevention services firm Transactis and logistics company Yodel. They will be joined by seven of the world?s leading cyber security companies: McAfee, CGI Canada, Atos, Cassidian, Digiware, Core Security

Technologies and Trend Micro, who have thousands of experts analyzing security issues 24/ 7, all of whom will feed their expertise into the study.

Also participating in Project 2020 are experts from two global professional communities ? the International Information System Security Certification Consortium (ISC)2 and the International Association of Public Prosecutors.

?During the past few years increasingly sophisticated and highly targeted cyber attacks have resulted in significant losses ? not only financial but also, potentially even more worryingly, of intellectual property in defense and aerospace, oil and petrochemicals, financial services, manufacturing and pharmaceuticals,? says ICSPA chief executive John Lyons. ?Cybercrime is notoriously difficult to tackle given the international structure and capabilities of some of the criminal networks we see in operation. It used to be inherently difficult to combine international efforts to fight cybercrime; this Project will for the first time, bring together experts globally, with a remit to identify and fix weaknesses in our systems before they come to market.?

Project 2020 is set up as an international effort to provide insight into how cybercrime will develop. The project will deliver information and recommendations that raise awareness amongst governments, businesses and citizens to help them prepare their defenses against future threats. The Project will deliver policy briefs and white papers on evolving threat scenarios, and establish a monitoring mechanism to assist organizations that combat cybercrime.

?Cybercrime evolves as quickly as technology, and technology develops so quickly that the unthinkable becomes mainstream before we can imagine. Furthermore, criminals today can still surprise us as they move from region to region around the world. We have the groups around the table who can make sure this will no longer be the case,? says Europol?s Dr. Baines, who will be the Project Director for Project 2020.

The Y-ME National Breast Cancer Organization, a support group formed in 1978 by a south suburban woman and her friend, has closed its doors, the organization said in a statement posted on its Facebook page.

The Chicago-based national organization helped breast cancer patients receive support, access information and make informed decisions about their health care, all as free services. It relied heavily on fundraisers, including its annual walk and race most recently held at Grant Park in Chicago in May.

Race organizers told the Sun-Times that day that fundraising may have been hurt by bad publicity when another breast cancer charity, the Susan G. Komen Foundation, cut funding to Planned Parenthood, a decision the Komen Foundation later reversed.

The statement about Y-ME?s closure did not provide a reason for the shutdown.

?It is with deep regret that we inform you that Y-ME has closed its doors,? the statement, posted Thursday on Facebook, read. ?For over 30 years, we were the primary organization that provided support and information from peer counselors who truly understood the complex and challenging world of a breast cancer diagnosis. We were unique. We were compassionate. And you were there to help. There are no words to express the sadness we all feel but we felt it important that you hear this news from us directly. Thank you for everything you have done for Y-ME over the years.?

The nonprofit?s website was shut down Friday, and numerous calls resulted in busy signals.

The organization was started by Mimi Kaplan and Ann Marcou, the latter an Olympia Fields resident when she died in 2004.

Marcou, who beat breast cancer but later died of advanced small cell lung cancer, would get out of bed at 4 a.m. to counsel a fellow breast cancer sufferer if the telephone rang.

The organization sprang from those humble beginnings.

Marcou had started work on a graduate degree in therapeutic counseling at Governors State University when she met Kaplan, a university librarian and fellow breast cancer patient. They called their support group ?Why Me,? but later changed it to ?Y-ME? in honor of the Park Forest YWCA, which gave them their first office space. It later moved to Homewood, and eventually Chicago.

Back then, there was little information available to the public about breast cancer and virtually no support services. The women believed learning about the disease and discussing their emotions could help ease the isolation and difficulty of their diagnosis. They invited other breast cancer survivors to an informal coffee and knew they had found an unmet need when more women attended than had been invited.

Marcou began running a hot line from her kitchen, answering questions and providing support.

After Kaplan?s death in 1982, Marcou kept expanding services to help anyone touched by breast cancer, starting with a 24-hour Y-ME National Breast Cancer Hotline staffed entirely by breast cancer survivors, with interpreters available in 150 languages.

The hot line was taking more than 40,000 calls per year, and support was such that more than 30,000 people attended the fundraising race in May.

Is Obama's tax plan a 'job-killer'?

Conservatives say the tax plan will harm small businesses ? the nation's top job creators. But Obama says only about 3 percent of such firms are affected, while others call the tax-hiring link 'simplistic.'

That question arises because it is presumptive GOP nominee Mitt Romney?s central criticism of the plan. Mr. Romney doubled down on this assertion at a campaign event Tuesday in Grand Junction, Colo., saying that higher taxes on ?job creators and small businesses? are the last thing the struggling economy needs.

?That will kill jobs,? Romney said at the event.

On one level this analysis reflects basic Keynesian economics, say some conservative economists. Repealing tax cuts is indistinguishable from raising taxes, whatever the income level of the affected taxpayers. And raising taxes takes money out of the economy that otherwise might get spent on food, clothes, cars, and so forth.

?Perhaps [Obama] is unaware that the economy is struggling and that no reputable economic research supports the idea that raising taxes is good policy,? writes Douglas Holtz-Eakin, former chief economic adviser to Sen. John McCain?s 2008 presidential campaign, in National Review's The Corner blog.

On another level, say conservatives, the proposal to increase taxes on wealthier individuals will disproportionately hurt the largest job creation machine in the US economy ? small businesses. That is because about 4 million small businesses with employees ? sole proprietorships, partnerships, and other so-called ?flow-through? firms ? report their income on individual tax returns, according to US Treasury figures.

Of these, about 1.2 million report income greater than the cutoff for Mr. Obama?s proposed tax increase: $250,000 for couples filing jointly or $200,000 for individuals. This small, relatively successfully group reports about $341 billion in income. That?s 91 percent of the money earned by all flow-through employer businesses, according to Curtis Dubay, senior tax policy analyst at the Heritage Foundation.

Building a satellite, that's not really much of a problem anymore. Getting them launched, well, that's what separates the big boys from the wannabes. Virgin's Richard Branson believes he has the answer to that -- LauncherOne. The delivery system for Earth orbiters is based around the WhiteKnightTwo, the same launch platform used by SpaceShipTwo to reach its sub-orbital heights. The tube-like rocket of the LauncherOne is carried up to 50,000 feet by its mother ship, before detaching and initiating its two-stage rocket engines. The current design is capable of delivering 500-pound payloads into Low Earth Orbit, while lighter satellites of 225 pounds could reach Sun-Synchronous Low Earth Orbit. Virgin Galactic says it has already signed up its first customers, including SkyBox Imaging and GeoOptics. Sadly, there's no word on when or how much it'll cost to get the spy satellite you built in your backyard placed in the heavens. Check out the video and the PR after the break.

Update: We now know another of Virgin Galactic's customers. Asteroid mining startup Planetary Resources has announced that it will "launch several constellations of Arkyd-100 Series spacecraft in the coming years aboard LauncherOne."
