Voter ID laws in the balance as court considers Voting Rights Act

On Wednesday, the Supreme Court hears arguments over whether a key part of the Voting Rights Act?a cornerstone of the civil rights movement?is unfairly targeting southern states for systematic racial bias that no longer exists.

The court's decision on the law, which helped dismantle decades of discriminatory voting restrictions in the South, could hand a victory to the recent conservative-led movement to tighten identification requirements and limit early voting hours at the ballot box. A wave of such laws swept 30 states over the last few years.

Supporters say these laws were designed to combat voter fraud. But they have attracted lawsuits from civil rights groups and the federal government, who argue that the laws disenfranchise minority citizens, who are less likely than white voters to have photo ID. (The Brennan Center estimates that about 11 percent of voting age citizens do not have a government issued photo ID.) The laws also sparked a political argument, with some Democrats accusing Republicans of pushing voter ID laws because they affected constituencies that tended to vote Democrat.

Some of these state photo ID laws in the South have been aggressively fended off by the Justice Department, which argued that states covered by the 1965 Voting Rights Act cannot change election law in this way because it disadvantages minority voters. Section 5 of the Voting Rights Act, reauthorized by Congress in 2006, gives the federal government the ability to preemptively reject changes to election law in states and counties that have a history of discriminating against minority voters. The law covers nine states and portions of seven more.

The Justice Department used Section 5 of the law to block voter ID laws in Texas and South Carolina last year, and also struck down early voting restrictions in five counties in Florida. (Minority voters are more likely than white voters to vote early in person.)

Justices in the conservative wing of the Supreme Court, including Chief Justice John Roberts, have expressed reservations that the nine Southern states covered by the law still require the same degree of federal oversight that they did 60 years ago. "Voter turnout and registration rates [between blacks and whites] now approach parity," Roberts wrote in a decision in 2009. "Blatantly discriminatory evasions of federal decrees are rare. And minority candidates hold office at unprecedented levels."

Another argument against Section 5's constitutionality is that it's unclear whether minority voters in Southern states are more likely to face discrimination at the polls than they are in other states. Voter ID laws, for example, have passed in states such as Wisconsin, Pennsylvania and Indiana. Since those states do not have a history of voter discrimination?and are not covered by the act?their voter ID laws did not have to first pass federal inspection. That said, southern states covered under the act were much more likely to pass a voter ID law than other states. Seven of the nine states covered in full under the act adopted such a law, compared to 19 states overall.

If Roberts and at least four other justices decide to strike down the part of the law that singles out the southern states, civil rights advocates will have few places to go in challenging voter ID laws. The Supreme Court upheld Indiana's photo ID law in 2008, suggesting that without Section 5, voter ID laws will prevail in the courts.

Rick Hasen, an expert on voting law at the University of California at Irvine, said it would be "tough" to win a case against a voter ID law without Section 5.

Wendy Weiser of the non-profit Brennan Center, which has challenged some voter ID laws as discriminatory, says Section 5 is a "potent tool" against the laws. "It's a much heavier litigation burden," without Section 5, she said.

The 51-year-old Culture Club singer-songwriter has become the latest celebrity to undergo a dramatic weight loss thanks to a shift to healthy eating. This week, he posted a photo to Twitter showing off his new thin frame, crediting the transformation to "portion control, 5-hour gaps between meals, no coffee or tea, except at meals. No bread or sugar. Water & fizzy water between meals!"?

George also tweeted a link to FreerNutrition.com, calling it "my secret." The website is the personal page of Amelia Freer, a nutritional therapist who provides personal consultations, workshops, and other healthy living guidance to clients.?

"I am a real foodie and absolutely encourage the enjoyment of food! My guidance is realistic, practical and achievable ? always with the goal of improved health and well being," she writes on her site. "In additon to one-to-one consultations, my services extend to helping clients with all aspects of nutrition, from empowering them to make intelligent choices at the supermarket, clearing and restocking kitchen cupboards, teaching the cooking of simple, healthy meals and providing realistic meal plans to suit all lifestyles."

All of those healthy meals appear to be rubbing off on George, who has posted pictures of dishes like Cannelloni Bean & Veggie Curry and Spicy Broccoli Cheese. In a Feb. 7 tweet, he went a bit further saying, "If you eat processed food you are already a walking chemical waste bin."

California facing doctor drought in wake of U.S. health care reform

California has been preparing for drastic changes to our medical system since the approval of the Affordable Care Act, expected to launch in 2014.

But alongside the benefits, the state also faces the challenge of making the implementation work, and some experts worry that our already overpacked system may collapse. According to the Los Angeles Times, the California HealthCare Foundation (CHCF) has proposed possible solutions to address the concern of flooding the system, but, as in any democracy, not everyone agrees on what is going to work.

Among such topics is the redefining of who can provide health care, which would expand the field of primary healthcare physicians to include physician assistants, nurse practitioners, pharmacists and optometrists. This would allow relief to the underserved counties that lack physicians. The CHCF is also calling for incentives to relieve recent MD graduates of school finances by serving such counties for their first three years in residency.

Critics of these ideas insist that expanding primary physicianship will both endanger patient safety and increase costs. Under-experienced workers tend to ?order more tests and prescribe more antibiotics.?

Put simply, these incentives will take years to create more coverage for depreciated counties?years that we don?t have.

Anyone who has visited an urgent care can testify that the total amount of time spent with the doctor is equivalent to the time it takes us to change one?s underwear. Most of the leg work is done by the nurses. I have seen plenty of physicians enter a patient?s room with a computer, arriving to a diagnosis after entering symptoms into their software.

I?m pretty sure this work can be extended to the professions previously listed above. It?s not like we are asking them to perform brain surgery.

According to a report from California Watch, implementation of the ACA may have unforeseen costs which unfortunately may come at the expense of our state?s children.

The report identifies a focus of concern toward a bill passed in November of 2012 that would abandon the California Healthy Families insurance program, which insures children whose family income is too high for Medicaid but too low for private insurance. The proposal was approved through the Brown administration as a budget cut to improve revenue by saving up to $72 million per year. The bill will affect 870,000 children currently enrolled in Medi-Cal.

That bill was to be effective in January 2013 but was delayed to March due to reports of possible physician abandonment. It is expected to be implemented in four phases, ending in August.

The current debate with Medi-Cal is whether or not most physicians will reject potential patients due to extremely low reimbursement rates?almost 50 percent less than Medicare. So healthcare providers will gladly accept older patients, who are covered by Medicare, over children who cannot possibly provide healthcare for themselves, all because they are guaranteed a paycheck? Unfortunate, but seemingly the case.

A report in November 2012 by Health Net, which currently covers 86,000 people under Healthy Families, gave notice to the state, stating ?it can?t say how many of its doctors will continue to see children after they are moved from the better-paying Healthy Families program to Medi-Cal.?

Unfortunately, the constant bickering most conceivably boils down to loss of money. At its most obvious (insurance companies) to its most disappointing (the workforce), everyone is scared of taking a pay decrease that will benefit millions of Californians.

But it may not have to come to that.

A report released by the Institute of Medicine found that the U.S. health care system wastes $750 billion each year. ABC News reported that this money could have provided health insurance for 150 million Americans. Reports like these can help aid waste expenditure so the multi-trillion dollar health care system won?t lose a precious penny.

I?m sure the great thinkers of America can figure out a way to make this system?which already functions in most other developed nations?work. The future of health care in California might just depend on it.

The story of a man, his wallet, and $800

Three years ago, trash collector Harold Walls lost his wallet, which held $800. Turns out, though, the wallet wasn't really lost?it was on vacation. And thanks to a good Samaritan, Walls finally has it back.

DelawareOnline.com has the full story. Walls had assumed he dropped his wallet while collecting trash one morning. He and his partner retraced their steps. Alas, no luck.

"I wrote it off, honestly," Walls told DelawareOnline.com of the wallet and money, which he'd planned to use to buy a TV. "Ain't no sense in harping about it or crying over spilled milk. Keep moving."

In 2012, the truck Walls and his partner used was retired by the city and sold at auction to a farmer up in Maine. The farmer took apart the bench seat in the truck's cab and, lo and behold, he found the long-missing wallet. The farmer mailed it back to Walls, cash included.

"I was real surprised it came back with everything. ... It happens to restore a lot of faith that there are still some good people out there," Walls said.

It also serves as a good reminder: If you're missing something, check underneath the cushions.

March is shaping up to be one busy, busy month. I thought I?d write it all down just to wrap my head around it a little ? and of course to share with you too.

International Women?s Day

On Friday March 8th, I will be speaking at Camberwell for the City of Boorondara. The talk is subtitled ?Celebrating women in Australian literature and the media? and I will be there to talk about my thoughts about, and contributions to, the blogging/digital sector. Fellow speakers are Leslie Cannold, Alice Pung and Michelle Dabrowski. It?s a free, family-friendly event.

I will be judging the creative writing component of Artz Blitz 2013 ? 24 hour Art Competition. What is Artz Blitz?

Artz Blitz is Kingston Arts? annual adrenaline-charged?art competition and is one of Melbourne?s most exciting creative events for artists and aspiring artists. The competition starts with the announcement of a secret theme from which artists have 24-hours to create an artwork and submit it to the Kingston Arts Centre. Artists work in a fun and frantic way to complete their artwork on time.

All this on top of what I?m planning to be a jam-packed blogging month here on Miscmum. And my two Piscean males celebrate their birthdays in March, don?t forget.

Is Oscar Pistorius really Africa's 'biggest' story?

For much of last week, the most popular news out of Africa was about a white man, former Olympic athlete Oscar Pistorius, being in court for the killing of his girlfriend, model Reeva Steenkamp, in South Africa.

Meanwhile, the world media paid much less attention to the United Nations mediating a peace agreement for the Congo conflict, the exodus of 60,000 refugees from a conflict in the Central African Republic, the United States setting up a Predator drone base on the continent, French troops chasing Al Qaeda in Mali, or Egypt?s economy on the verge of collapse as it appeals for foreign loans.

Oh, and then there is the news about the International Criminal Court seeking to put on trial the possible winner of Kenya?s March 4 presidential election, Uhuru Kenyatta. He is wanted for crimes against humanity.

Africa?s worst woes ? conflict, poverty, and poor governance ? are receiving greater and greater attention from foreign governments, especially in aid and intervention. And yet, among voters in those giving countries, Africa receives little attention ? except for sensational news such as the Pistorius murder trial. The severity of Africa?s basic needs are not at all equal to the exposure of those needs to the world.

The US military, for example, is considering a 15-fold increase in its troop levels in Africa, now about 5,000. But few Americans know about or understand the specific security concerns or other issues on the continent in recent years compared with past crises such as famines or the war in Darfur. And few take meaningful action to address them. The one big exception was the brief popularity last year of a viral video, ?Kony 2012,? about the Lord?s Resistance Army.

The West has intervened again and again in Africa recently ? Somalia, Ivory Coast, Mali, Libya, as well as in the hunt for Joseph Kony?s rebels ? while also trying to build up the military forces of African nations and to coax them to intervene in regional conflicts to establish security. Often these efforts succeed or contain a problem. The West?s assistance, however, depends on the humanitarian mood in Europe, the US, and Canada. At a time of budget austerity in those countries and with fewer foreign news bureaus in Africa, Western governments have a difficult time finding a political constituency at home for their actions. In the US, the most popular item for spending cuts is foreign aid, which takes less than 1 percent of the budget.

As much as the West tries to implement the idea of ?African solutions to African problems,? it still finds itself leading in the solutions, often with the assistance of the UN or private international groups. A good example was the French invasion of northern Mali in January to roll back a threat by Al Qaeda. Now the French want out, but their withdrawal depends on whether troops from nearby African countries can be trained and financed to take over the mission. The French people supported the invasion but don?t seem willing to support an extended stay.

An uprising last December by rebel groups in the Central African Republic has received very little world attention and yet the spillover of refugees into neighboring countries could lead to regional instability or humanitarian worries about their condition. If the Western leaders are inclined to intervene, will their people even know where the CAR is?

This disconnect between the world?s awareness of Africa and the need to respond to Africa?s problems needs attention itself. Western leaders, such as President Obama, must travel to the continent more often. News coverage must increase. African leaders need to engage the outside world more. Perhaps then news of a sensational killing in Africa won?t receive more attention than it should.

High Blood Pressure-Ways to Reduce Your Risk and Improve Your Health

According to current estimates, almost one in three U.S. adults has high blood pressure. But because there are no symptoms, almost one-third of these men and women aren?t even aware they have it (which explains why it is known as the silent killer).

Uncontrolled high blood pressure can lead to stroke, heart attack, heart failure or even kidney failure. The one and only way to know if you have hypertension is to have your blood pressure checked on a regular basis. Having it checked by a professional ensures accurate readings.

By getting the facts on high blood pressure, you will learn how to live a heart-healthier life. High blood pressure directly increases the chance of coronary heart disease which leads to heart attack and stroke, particularly when it?s combined with additional risk factors.

High blood pressure can appear in children or adults, but it?s most commonly found in men and women over the age of 35. It is also predominant in those people who are one or more of the following:
-obese
-over the age of 50
-African-Americans
-heavy drinkers
-and in women who take birth control pills.

It may run in a family?s history, but in some cases, people with a strong family history of high blood pressure never develop it themselves. Also, men and women with diabetes mellitus, gout, or kidney disease are often prone to having high blood pressure.

Even if you have high blood pressure, you can lower your risks for heart attack and stroke with proper monitoring by a health care provider and easy lifestyle changes.

Alcohol Use. Over 9% of high blood pressure cases are brought on by alcohol misuse (two or more drinks per day); the more alcohol consumed the greater possibility of having high blood pressure.

In studies it was concluded that the abuse of alcohol could result in elevated systolic pressure and a decreased diastolic pressure. Also of surprise, it was found that people who just went out occasionally and drank heavily had even higher blood pressure than men and women who drank daily. Moderate drinking (less than two drinks a day) may have some benefits for the heart and may even guard against different types of stroke.

Of some concern was a study denotative that even low or modest drinking may heighten the danger for hypertension in African-Americans. Red wine, specifically, may have chemicals that benefit blood pressure; red grape juice may have the same advantages. It is critical, in any case, for men and women who can?t drink in moderation to refrain from alcohol all together.

Smoking is a significant risk consideration. One study reported that smokers typically have blood pressures up to 10 points higher than that of nonsmokers.

Caffeine causes an increase in one?s blood pressure temporarily, which was thought to be safe in men and women with normal blood pressure. Studies are indicating, however, that routine, heavy coffee drinking (an average of 5 cups per day) can raise blood pressure, and there is developing corroboration that a high consumption of coffee may be dangerous in men and women with hypertension and may even heighten their danger for stroke. Drinking coffee also increases loss of calcium, which also may affect blood pressure. Anyone who drinks coffee should retain a sufficient calcium intake.

Obesity; nearly one-third of patients with elevated blood pressure are obese. Even somewhat overweight adults have twice the danger of hypertension than men and women with acceptable weights. In reality, the rise in blood pressure in aging Americans may be due principally to weight increase. In other cultures, old age does not automatically line up with weight increase or elevated blood pressure. Children and adolescents who are overweight are at increased danger for developing hypertension when they become adults..

A diet known as ?Dietary Approaches to Stop Hypertension? (DASH) is now being used in efforts to better control blood pressure. This diet is not only loaded in significant nutrients and fiber, but also includes foods that are superior in supplemental calcium, magnesium, and potassium than those that are currently in the typical American?s dietary intake.

-Refrain from saturated fat although incorporate calcium-rich dairy products that are no- or low-fat. When choosing fats, pick monounsaturated oils, such as olive or canola oils. One study reported a reduced requirement for antihypertensive medicines in men and women with a high consumption of virgin olive oil, but not sunflower oil, a polyunsaturated fat.
-Select whole grains or multigrain bread, not white bread. The same holds true for pasta.
-Chose from a select choice of fresh fruits and vegetables every day. Most of these foods are loaded in fiber, which may assist you to lower your blood pressure.
-Substantial foods that will assist you in lowering your blood pressure are mostly fruit?specifically those rich in potassium which could include bananas, oranges, cantaloupes and prunes?as well as vegetables such as carrots, celery, spinach, alfalfa, mushrooms, lima beans, avocados, potatoes, and broccoli.
-You should also consume nuts, seeds, legumes, dried beans or peas, cooked turnip greens, salmon, cottage cheese, low-fat milk, and yogurt as part of your daily nourishment.
-Select and choose smaller portions of protein?preferably chicken, turkey and fish, or soy goods.
-Soy products combined with foods that contain fiber or supplements may have definite benefits.
-Oily fish may also be extremely favorable as they contain omega-3 fatty acids, which have been connected with heart and nerve protection.
-Most people know that salt is bad for people with high blood pressure, but they are unsure how best to reduce their intake. Controlling and maintaining a normal blood pressure is one area that we do have some command and control over. By keeping blood pressure levels within an acceptable range, you will also be eliminating other possible health problems in the future. Check your blood pressure on a consistent basis, and if it starts to elevate into the higher-than-normal levels, it is important to check with your physician. Strokes and heart attacks are irreversible!

If not 'sequester,' then what? Five ideas from left and right.

Few in Washington believe that ?the sequester? ? automatic spending cuts that will hit the federal budget to the tune of $85 billion as of March 1 ??is a good idea. It has been described variously as a blunt instrument, a cleaver, stupid, and akin to shooting the Department of Defense in the head.

But what?s been proposed as an alternative?

Well, members of Congress, the White House, and deficit-reduction gurus Alan Simpson and Erskine Bowles (remember their special bipartisan commission?) have all put forward their plans to replace it. The thinking is that surely there is a better way than to proceed with the sequester?s across-the-board cuts for every line in the federal budget, as if each is of equal importance.

While the sequester will require cuts in nearly all core federal functions, some slices of government are exempt. Social Security payments will still go out as usual. Active-duty military personnel won?t be cut; nor will services for veterans. Some social services, including nutrition assistance and the Medicaid health program for poor Americans, are also exempt from cuts.

But pretty much everything else is sequester-eligible. What to do instead? Here are five anti-sequester options that are out there.?

1. The defense hawks: ?Shrink the federal workforce instead?

Top Republicans on the House and Senate armed services committees (Rep. Buck McKeon of California and Sen. Jim Inhofe of Oklahoma, respectively) are among those who have joined stalwart defense hawks like Sen. John McCain (R) of Arizona to propose this one-year fix: Slash the federal workforce instead of making all the other cuts (in the process staving off $42.7 billion in cuts to the US military this fiscal year).

The defense hawks would shrink the federal workforce by 10 percent through attrition ? or about 210,000 positions. Federal agencies would be allowed to hire one person for every three who leave, netting $85 billion in savings over 10 years. The bill also freezes lawmakers? pay.

Such a hiring regimen would allow each federal agency to direct new hires to its most vital divisions instead of instituting across-the-board cuts. The lawmakers propose a fix for a single year, in the hope that a broader compromise might be reached within that period.

Lindsey Graham (R) of South Carolina said in early February at a press conference introducing the bill. ?Lead us to a better solution. For a bad time, visit America's 'saddest,' 'most miserable' cities

Forbes ranked Detroit as the "most miserable" city in the U.S., citing its violent crime rate and falling home prices, both of which are the worst in the country.

Michigan has a serious PR problem on its hands, if you believe two studies this week that ranked its cities among the saddest, most depressed in America.

Forbes magazine hit the state with a top two finish Friday in its annual rankings of the "most miserable" cities in the U.S. Detroit ranked No. 1. Flint ranked No. 2.


Forbes' rankings are based mainly on economic factors, including unemployment, foreclosures, income and property taxes and home prices, in addition to violent crime. Detroit ranked high on violent crime and the rate at which home prices are falling.

"Right now, it's all about survival," Mayor Dave Bing told Forbes.

In a separate study this week, mathematicians at the University of Vermont ranked the 373 "saddest" cities in the U.S., based on a quantitative analysis of keywords in more than 10 million geotagged posts on Twitter.?

Detroit finished 29th. Flint was even sadder ? its residents were the sixth-saddest in the country, according to the Vermonters.

(Adding insult to injury, Warren, Mich., shows up at seventh on Forbes' list.)

The Midwest, in fact, is heavily represented in both lists. Forbes' 20 most miserable cities also include Rockford, Ill. (third); Chicago (fourth); Lake County, Ill. (ninth); Toledo, Ohio (11th); St. Louis (12th); Milwaukee (14th); Cleveland (17th); Gary, Ind. (19th) and Youngstown, Ohio (20th).

Battle Creek, Mich. (eighth), and Lima, Ohio (ninth), also show up in the 20 saddest cities.

"This is not a league in which we want to play ball," Chuck Sweeny, political editor of The Rockford (Ill.) Star, wrote in a column Friday.

"We know what's wrong: too much poverty, too few college graduates, too few opportunities to get a college degree here, high crime in certain areas, an inability to work together to coordinate economic development and school districts considered poor or just average," Sweeny wrote.

"Add to that a crumbling inner city and thousands of substandard homes, and you've got a problem when the ratings folks come to town, or more likely, Google us."

At least "we are nothing like Flint," he added.

From Flint, the counterargument:

"This is ridiculous. I am proud to be from Flint, MI," Manuel Gatica of New York ? a Flint native ? commented on Facebook. "I enjoy going back to visit and I live in New York, New York. I am a very happy person. The writer at Forbes must have a miserable life."

Detroiters, however, generally seemed to agree with their ranking, at least as indicated in comments at NBC station WDIV of Detroit:

The happiest city in America is Napa, Calif., the Vermont researchers concluded. The saddest? Beaumont, Texas. It's just one of many Deep South municipalities at the bottom of the list ? and many in the region aren't happy about it.

"Albany is home. I wouldn't imagine being anywhere else," said Layne Tumlin of Albany, Ga., which ranked second on the saddest cities list.

"I did leave and come back," Tumlin told NBC station WALB of Albany. "I left for a few years, about eight, and traveled ? got it out of my system, but the whole time I was gone, I kept thinking about home."

"I hate that we have such a stigma like that," said Nancy Jane Karam, who told NBC station KSLA of Shreveport, La. ? No. 4 on the Vermont list.

Bill McCown, a psychology professor at the University of Louisiana at Monroe, said he was dumbfounded at Monroe's No. 5 ranking on the "saddest" list.

"If you would have said this about New York, I would have believed it," McCown told the News-Star newspaper. "But not Monroe."

Freezing drizzle possible for London region Friday

Southwestern Ontario may be hit with freezing drizzle Friday afternoon, Environment Canada is warning.

In a special weather statement issued at 5:21 a.m., forecasters say the freezing drizzle could last for several hours before changing to drizzle or rain showers as temperatures rise.

"Untreated surfaces may become icy and slippery making for hazardous travelling conditions," the special weather statement said.

The low pressure system spreading into southern Ontario may also bring two to five centimetres of snow and low visibilities.

Vestas cuts 110 Colorado jobs at Brighton, Windsor blade factories

Vestas Wind Systems ? which operates four factories in Colorado employing 1,100 people ? is cutting about 110 jobs from its blade factories in Windsor and Brighton.

Workers at the factories had been on a reduced 32-hour workweek; with the job cuts, the remaining employees will return to a 40-hour week, Aarhus, Denmark-based Vestas said in a statement.

The move comes in response to a drop in orders as the federal wind-production-tax credit, a key element in financing wind farms, was renewed in January for just one year, the company said.

Vestas knew the late timing of the federal production-tax credit, or PTC, extension, would result in a significant reduction in 2013 installations, the company

said.

"It may take a few months for the PTC to take effect," said Peter Kelley, a spokesman for the American Wind Energy Association, an industry trade group.

"But the extension of the PTC doesn't solve all the problems," Kelley said. "We are still faced with the uncertainty and this start-stop cycle that is hard on manufacturers."

The tax credit is equal to $22 per megawatt that a new wind farm generates for the first 10 years.

In a scramble to get the tax credit before it expired , a record 13,000 megawatts for projects were installed in 2012, representing about $25 billion in investment, according to the Wind Energy Association.

The jobs cuts do not affect Vestas' nacelles factory, which manufactures casings, in Brighton or its tower factory in Pueblo, the company said.

"Vestas will continue to scale up or down depending on business needs and market demands," the company said.

In the past year, Vestas has reduced its Colorado workforce from 1,700 to about 1,000 with the current reductions.

In January, Vestas announced that it would start making towers at its Pueblo plant for other wind companies ? a deal that would create more than 100 new jobs.

For 12 years, Vestas had been the world's largest wind-turbine manufacturer, but in 2012 it was overtaken by the General Electric Co.

GE is also the top wind-turbine maker in the U.S. market, with Vestas second.

Feds join civil lawsuit against Lance Armstrong

WASHINGTON (Reuters) - Disgraced cyclist Lance Armstrong has failed to talk the U.S. government out of suing him to recover sponsorship money that the U.S. Postal Service paid his teams to compete in international events, Armstrong's lawyer said on Friday.

Lawyer Robert Luskin said: "Lance and his representatives worked constructively over these last weeks with federal lawyers to resolve this case fairly, but those talks failed because we disagree about whether the Postal Service was damaged."

"The Postal Service's own studies show that the service benefited tremendously from its sponsorship - benefits totaling more than $100 million," the lawyer said in a statement.

A U.S. Justice Department spokeswoman had no immediate comment.

Former Armstrong teammate Floyd Landis was believed to have filed a sealed whistleblower suit against Armstrong in 2010. A decision by the government to join the suit would trigger its unsealing.

Public court records did not indicate that a lawsuit had been filed as of mid-day on Friday.

Though the Steelers are likely set at the safety position in terms of starters in 2013, with Troy Polamalu and Ryan Clark reprising their roles, that doesn't mean they're set when it comes to depth.

Both Will Allen and Ryan Mundy are unrestricted free agents and represent the best of their safety depth?okay, "best" might be a stretch when it comes to Mundy?which will require the team to make an addition at the position in the draft.

What the Steelers need is someone who can contribute in nickel and dime situations right away (as well as on special teams) but who could blossom into a starter to replace Clark and/or Polamalu in as little as a year's time.

Luckily for the Steelers, this year's safety class is deep and talented, so they won't need to spend their first round pick on someone who can provide them with that kind of profile.

One option is Jonathan Cyprien from Florida International. As a small-school prospect, Cyprien has the opportunity to increase his draft stock while getting some close attention by scouts from around the league.

Cyprien should already be on the Steelers' radar, however, based on his Senior Bowl performance, which featured both hard-hitting,?run-stopping plays and solid coverage skills.

Cyprien's stock could rise enough that he could become a second-round pick for the right team, and the Steelers could certainly make that move; however, he could end up being a high-value third- or fourth-round selection as well.

The combine will give the Steelers a close enough look at Cyprien to help figure out just what he'd be worth for them.

Discovery of smallest planet yet a 'milestone' in search for another Earth

The Kepler space telescope has found a planet smaller than Mercury orbiting a distant star. The discovery suggests Kepler has the precision to find a planet more like Earth.

For nearly 20 years, astronomers have filled the pantheon of planets beyond the solar system with objects ranging from behemoths several times Jupiter's mass to small orbs somewhat less hefty than Earth.

Now, a team reports finding the smallest planet yet ? a true pipsqueak orbiting a sun-like star some 215 light-years away near the constellation Cygnus. The planet has a mass at least 1 percent of Earth's mass, probably more. And it's about 30 percent Earth's size. This is slightly larger than the moon, which is 27 percent the size of Earth.

The planet, one of three in the system, orbits its host star once every 13.4 days.

Finding the smallest planet yet is more than an "isn't it cute" moment, suggests Thomas Barclay, an astronomer at NASA's Ames Research Center at Moffett Field, Calif.

"This is a milestone" on the path to finding Earth-like planets, says Dr. Barclay, who is the lead author of a report of the find, which appears in Thursday's issue of the journal Nature.

The observations come courtesy of NASA's Kepler mission, a sensitive space telescope that observes more than 150,000 stars simultaneously in and near the head of Cygnus around the clock. Kepler's ultimate goal is to find Earth-like planets orbiting sun-like stars at Earth-like distances.

Kepler 37b, as the planet is known, is more like a mini-Mercury but on a much tighter orbit. But "the sort of precision we need from the instrument" to achieve the mission's goal "is demonstrated through this discovery."

In essence, the planet's very weak signature at some 9.3 million miles from its star is comparable to the signature researchers expect to see from an Earth-mass planet 93 million miles from its star, Earth's average distance from the sun. A planet betrays itself to Kepler by dimming its star's light repeatedly as it passes in front of it, a process astronomers call the transit method for detecting extrasolar planets.

The detection of Kepler 37b was extremely difficult, Barclay says. Many transits were needed to build up enough data to spot the dimming the planet imparts to the star. And Kepler's ability to take very precise measurements of the star's own light helped the team develop a highly accurate estimate of the star's size and mass.

Just as geophysicists can use earthquake vibrations traveling through the Earth to reconstruct the planet's interior, astrophysicists can use the same approach for determining the structure of distant stars. Kepler takes the measure of a star by recording rapid changes in its brightness from what in essence are sound waves moving through the hot gas.

In some cases, Kepler's insight into a star has forced team members to boost the size and mass estimates of its planets. These revisions mean planets that were initially thought to be comparable in size and mass to Earth, often turn out not to be rocky planets in all likelihood, Barclay explains.

So when Barclay took his data suggesting a tiny planet to the Kepler mission's resident astroseismologist, the colleague was not optimistic. "But then he came running down the corridor saying: 'I've detected something!' " Barclay recalls. Extremely precise measurements of the star Kepler 37 indicated that it indeed was relatively small star, hence the initial estimate of Kepler 37b as a munchkin held up.

Unfortunately, independent efforts to confirm the planet's presence with Earth-based telescopes using a different detection approach ? which spots the wobble a star's spectrum displays from the gravitational tug of an orbiting planet ? came up empty.

Still, the Kepler team was able to rule out other possible explanations for Kepler 37's dimming to a high degree of confidence using statistical tools and the long observations of the star and its cosmic neighborhood.

Computer simulations suggest that the planet and its two siblings are in a stable configuration around the star, and that the planet likely is rocky and devoid of an atmosphere. The simulations also indicated that Kepler 37b would have swept its orbital zone clear of any debris left over from the system's formation some 6 billion years ago. This puts it squarely in the "planet" camp, despite its diminutive size, versus "dwarf planet," the category to which Pluto has been exiled.

"This is a hot planet on a short orbit," Barclay says. "The next step is to look for planets on longer orbital periods. It's just a matter of time. The longer you look, the further out in orbital period you can probe."

But he's not undervaluing this discovery.

"The fact that we are finding things smaller than we know of in our own solar system I think is really exciting," he says. "We're probing the architectures of other star systems."

PRLog (Press Release) - Feb. 21, 2013 - The CW Group nudges its 1H2013 worldwide cement volume forecast down, sees demand to rise 4.9% through 2017 after recovering in 2012 to 3.73bn tons. Globally, ex-China cement manufacturing capacity utilization expected to have reached bottom in 2012 of 66.6%, though regional divergence remains stark.

With global economic growth having been revised downwards for the last few cycles, 2012 is expected to have ended with a 3.2% rise. Though the year ended with the long fabled ?green shoots? of growth perhaps creeping into the vocabulary again, the expansion is uneven, uncertain and fragile. The impact on the construction sectors remains material and in some regions (notably Southern Europe) maintains a chokehold.

World cement volumes to grow by 4.9% p.a. on average through 2017

Worldwide cement consumption expanded 4.1 percent in 2012 and passed, based on the CW Group?s preliminary estimates, 3.73 billion tons for the year. As economic struggled, the estimate for the year was revised down by the firm from the previous 2012E view of 3.78 billion tons. On a longer-term basis, the CW Group sees global cement consumption expand by 4.9% on average per year through 2017. Global per capita cement consumption rose from 448 kilos in 2009, to 539 kilos in 2012 and expected to continue on to 645 kilos by 2017.

?Even though we remain cautiously optimistic that recovery is gaining a foothold in some of the core markets and problems in Europe are slowly being contained, if not resolved, many markets are still in the balance. In particular, we are happy to see the US turn-around progressing, but are also a bit nervous about some of the larger emerging markets if global economic conditions deteriorate,? said Robert Madeira, the CW Group?s Managing Director and Head of Research.

Ex-China manufacturing capacity utilization hits bottom in 2012

A rough measure of profit health and outlook for cement plant capex, cement manufacturing utilization rates point to improved conditions ahead. Having peaked in 2009 at 68.1%, but since deteriorating to 66.6% in 2012, the CW Group estimates that the bottom may have been found for the global ex-China manufacturing capacity utilization. When China is included, the recovery trend strengthened in 2012 to 77.2% after hitting bottom in 2010 at 75.6%.

?Based on a bottom-up tracking of greenfield and brownfield cement plant projects, as well as permanent and semi-permanent closures, we see utilizations improving through 2017 to 82%. However, with an abundance of new projects in growth markets, we do caution as we see supply outpacing demand in some markets,? explained Claudia Stefanoiu, Senior Analyst with the CW Group?s European Analytics Team.

Regional divergence: North America bungee jumps, frontier markets remain exciting, while Europe sinks into the abyss

Perhaps surprisingly, North America is projected to show one of the strongest consumption volume growth trends out of the global regions through 2017. In fact, we expect demand in North America, even on the conservative basis we use for the region, to trend just marginally above the demand growth in the Middle East of 7.1% per year on average. But the strong forward growth patterns for the two are based in part on fundamentally different drivers with North America being a recovery story in the US (we still do not expect to see a return to peak demand volumes during our forecast horizon), while the Middle East is driven by strong ?new? growth in Saudi Arabia, Iraq and to a smaller extent, recovery in the UAE, Syria and Oman.

We expect growth in China to moderate, but stay positive as the government is dead set to stimulate growth through infrastructure programs. Frontier markets in Sub-Saharan Africa and some recovering North African markets (e.g., Libya) will continue making this area an exciting market where we expect over 6 percent growth on average through 2017 for the region as a whole. Latin America is expected to decelerate somewhat, falling to 5.6% on average as Brazil growth moderates, while Asia ex-China will see growth accelerating with Indonesia and Philippines seeing strong growth in the next years.

Western Europe will slowly start showing a pulse again in the next few years as markets bottom out and the weakest (Greece, Portugal, Spain) run out of room to fall much further. Eastern Europe and the CIS will do better however, driven by the non-European markets in the near term with the region?s demand growing 5.2% per year on average through 2017.

Kurdish militia signs ceasefire with Syrian rebels

(Reuters) - Syrian rebels and a Kurdish militia that have fought each other for months in a town near the Turkish border have signed a ceasefire, averting the prospect of an Arab-Kurd conflict.

Syria's Kurds have exploited the civil war between forces loyal to President Bashar al-Assad and rebels fighting to oust him by asserting control in parts of the northeast, which have been spared the worst of the violence.

But the relative calm was shattered last November when mainly Sunni Muslim Arab rebels overran the ethnically mixed Syrian town of Ras al-Ain and Assad's airforce bombed it in the days that followed.

Until a deal was struck earlier this week, Kurdish fighters known as Popular Protection Units (YPG) had been battling to drive out insurgents from the Free Syrian Army (FSA), opening another front in Syria's near two year civil war.

Previous efforts to broker a truce repeatedly fell through.

"They were forced to sign an agreement to withdraw from the town," said YPG spokesman Khabat Ibrahim, who was present at the ceasefire signing ceremony.

"If the FSA respects us, we can join with them to liberate towns still under Assad's control".

Kurds in Syria see the war as an opportunity to win rights long-denied them by Assad and his father before him, but are wary of the Arab-dominated opposition, which they see as inherently hostile to their interests.

Those suspicions are fuelled by Turkish support for the rebels. Turkey has a fraught relationship with its own Kurdish population and has fought for years against the outlawed Kurdistan Workers' Party (PKK).

Ibrahim blamed Turkey for inciting the FSA to attack Kurdish fighters and warned they would not accept another incursion. "If they want to take Turkish orders, we will fight them again," he said.

The YPG says it has no political affiliations, but analysts say it has close ties to the PKK.

Rebels accuse Syrian Kurdish parties aligned with the PKK of colluding with Assad in return for him leaving them to their own devices and keeping out the FSA. That also serves Assad's interests by unnerving Turkey.

    Movie about Bruce Lee?s most legendary fight is in the works

    Bruce Lee obtained legendary status as a martial artist in part because of a 1965 fight in Oakland, Calif., against Chinese kung fu master Wong Jack Man. It was the last fight of Lee's career.

    For nearly 50 years, there has been much speculation and heated debate about what occurred inside of that gym, as very few people witnessed it. But the upshot of the bout is that it helped to develop Lee's views on Jeet Kune Do, which is the forerunner of today's mixed martial arts.

    On Tuesday, Deadline.com reported that a movie about the fight that will be called "Birth of the Dragon" will be produced by QED International and Groundswell Productions.

    Groundswell CEO Michael London told Yahoo! Sports on Tuesday that the process of developing a screenplay has just begun.

    It is not, however, designed to be a biography of Lee, who died in 1973, or the definitive account of the fight.

    "We're actually not trying to re-tell the story of Bruce Lee," London said. "I think that's a natural impression people might get. The idea, actually, is to take that battle, which has been so mysterious and so powerful and so interesting to so many, and tell the lead-up to that story, which is Wong Jack Man's arrival in San Francisco.

    "We've created a back story. There is a lot people that know about why Wong Jack Man came to San Francisco, but we're trying to create a dramatically satisfying story about why he's there. So we're taking license. That's why we say it's going to be inspired by that fight and isn't a literal telling of it."

    London said the writers -- Christopher Wilkinson and Stephen Rivele -- have the belief that Jack Man was trying to help Lee to become the best version of himself and was trying to teach Lee lessons.

    London said the fight sequences will be shown through the eyes of the people who were there. One of those was Lee's wife, Linda, who was eight months pregnant at the time with the couple's son, Brandon.

    "There will be a slightly stylized quality to the actual fight sequences," London said. "That will allow different people who were there to come away with differing conclusions of what happened. ... The whole idea is that the 13 people who saw that fight came away with very differing ideas of what happened. The fight itself will be impressionistic."

    Jack Man is reclusive and rarely does interviews and has rarely spoken of that fight. London said producers will approach him after finishing the screenplay. He said he hasn't reached out to Lee's family, either.

    Lee's daughter, Shannon, who runs the Bruce Lee Foundation, said that the fight was significant in her father's life because of the impact it had upon him.
